These terms apply to every kit bought on this site. By placing an order you agree to them. Our shipping & sales policy covers shipping, cancellations and refunds, and our privacy page covers your information.
An asbestos test kit: numbered sample bags, an outer bag, gloves and sampling instructions, with laboratory analysis of each sample you send back and shipping both ways where stated. The analysis is done by an independent laboratory accredited under the National Voluntary Laboratory Accreditation Program (NVLAP) for bulk asbestos, using polarized light microscopy (PLM). We submit your samples to the laboratory on your behalf and pass its report on to you as we receive it.
You take the samples yourself, at your own risk, from property you own or are allowed to sample. The instructions at testyourhouse.com/instructions, linked from your order emails, follow the home-sampling steps published by the EPA and the Consumer Product Safety Commission, with a few practical notes of our own marked as such, and you agree to follow them. The EPA and CPSC also say that taking samples yourself is not recommended, that a professional is the safer choice, and that sampling done incorrectly can be more hazardous than leaving the material alone. If you’d rather not take the samples, don’t: a licensed asbestos inspector can.
Each sample must be sealed in its numbered bag and the bags sealed in the outer bag before mailing, with the sample form filled in on the tracking page. Please send only small pieces of solid building material, not loose material, dust, or air or water samples. Samples must be mailed back within 90 days of delivery.
If we fail to deliver what you paid for (the kit, the analysis of the samples you sent, or the report), we’ll put it right or refund you. Beyond that, to the extent the law allows, our total liability for anything arising from a kit, its instructions, the analysis or the report is limited to the amount you paid for that order, and we aren’t liable for indirect losses, such as the cost of renovation work, delays, or the cost of other testing. The laboratory is independent of us; we pass on its report as it provides it. Nothing here limits liability that can’t be limited by law, including for our negligence causing personal injury, and nothing here affects consumer rights you have under California or federal law.
